Goods are warranted to be free from defects in material or workmanship, and to last for the lifetime of the vehicle. Gates will replace any Goods proved defective in material or workmanship, that are no longer able to perform for their intended use, provided the original Gates supplied kit was installed by a shop which is registered in accordance with information requirements on Gates.com/CompleteKits (a “Registered Shop”). The replacement must take place at a Registered Shop. Gates will pay the Registered Shop’s labor costs using the industry book time standard set by Mitchell 1 or AllData. This is the sole remedy for breach of warranty. Color fade and color difference is not warranted. This warranty is void if the defect is caused by improper installation, use or maintenance of the Goods, or used for racing or competition. Goods are not warranted to comply with laws that may apply to uses of the Goods not stated in related materials, e.g., use in manned or unmanned aviation or life support applications. THIS LIFETIME WARRANTY DOES NOT APPLY TO GATES COMPLETE HEAVY DUTY SERPENTINE KITS, TO COMPLETE SERPENTINE KITS WHICH ARE USED IN COMMERCIAL APPLICATIONS, OR TO COMPLETE SERPENTINE KITS WHICH WERE NOT ORIGINALLY INSTALLED BY A REGISTERED SHOP. GATES COMPLETE HEAVY DUTY SERPENTINE KITS, COMPLETE SERPENTINE KITS WHICH ARE USED IN COMMERCIAL APPLICATIONS, AND COMPLETE SERPENTINE KITS WHICH WERE NOT ORIGINALLY INSTALLED BY A REGISTERED SHOP ARE COVERED BY THE STANDARD GATES LIMITED WARRANTY, WHICH IS FOUND AT https://www.gates.com/us/en/knowledge-center/resource-library/policies-and-statements/limited-warranty.html. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED.
Some states do not allow the exclusion or limitation of incidental or consequential damages, and some states do not allow limitations on how long an implied warranty lasts, so the above limitation and exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
